Four Texas men were arrested on Aug. 17 based on information obtained by police regarding an assault that reportedly occurred that night. The men were being held in the Jefferson County Correctional Facility on charges of aggravated assault with a deadly weapon. The man said to be the victim of the supposed assault was hospitalized for treatment of his injuries. The current condition of the man is unknown.
When officers arrived at the location where the assault is said to have taken place, they found a man seriously injured and witnesses who provided information to the police. According to them, there were numerous people assaulting the man. Police were told that the assailants were carrying weapons. No other information was reported as to what led police to the four Texas men that are currently in custody.
The incident took place at approximately 9:35 p.m. It is not known how well witnesses were able to see the people who purportedly assaulted the victim. These and other important factors will merit careful; review as the case now heads to a criminal courtroom.
In general, the testimony of eyewitnesses is notoriously unreliable. There can be numerous witnesses to the same event, with widely varying accounts of what each claims to have seen. When it comes to a charge as serious as aggravated assault -- with or without a deadly weapon -- it is important that any claimed identification of the alleged assailants be challenged regarding its accuracy. If the identifications doesn't hold up in court, the court may be obligated to dismiss the charges against some or all of these men.
